Breeding birds and their nests are protected under the Wildlife Act/Order in the UK and there are a subset of species that are further specially protected by EU legislation. Various annexes also exist listing birds of conservation concern/priority species that are worthy of protection and a material consideration in the planning process. Surveys may be required prior to the commencement of development projects to ensure breeding birds are not affected.
